These rules and regulations have been set forth to provide a clear understanding of the guidelines under which the Villas at Presidents Row Condominium Association ("Villas") operates. All residents will be required to uphold the rules established by this document, as approved and voted on by the Board of Trustees and established by the Condominium Declaration and By-laws.

These rules and regulations supersede any past rules and regulations previously passed by the Villas Board of Trustees. These rules and regulations pertain to resident actions and conformity to established Villas standards. The Declaration and Bylaws remain in effect.

ARCHITECTURAL GUIDELINES

1. Personal Property

All personal property, such as lawn chairs, bicycles, etc., must be kept inside the garage or patio area. Nothing may be hung or displayed, nor any signs, awnings, canopies, shutters, televisions, CB or radio antennae or any other device or ornament be affixed to or placed upon the exterior walls, doors, fences or roof without approval of the Board of Trustees. The following minimum regulations have been established for personal items:
A. Wreaths
One wreath is permitted in the patio, not to exceed, 36 inches in diameter. Wreaths may contain artificial material such as bows for decorations.
B. Birdfeeders (tree-hanging variety)
Birdfeeders may not exceed 12 inches in width or 18 inches in height. Two birdfeeders are permitted per household. The tree in which the feeder hangs must be mature enough to safely support it.
C. Bird feeders (free-standing variety)
One free standing birdfeeder is permitted per household. It may be placed only within the patio area or outside the patio in an established mulch bed area. The post must be wood or metal, and the post and feeder shall not exceed 7 feet in height. The feeder may not exceed 18 inches square.
D. Flower/Plant Pots
A maximum of 4 flower/plant pots per household are permitted around the condo, outside the patio area. They may not be placed in any lawn area. They must be earth tone/black/gray in color. Plastic containers are permitted.
E. Hose Reels
Hose reels may be attached to the building by the water outlet. They are to be gray or black. Unattached hose reels can be gray, black or brown.
F. Storm Doors
Storm doors may be full view or self-storing full view. Approved colors are gray, bronze or brown.
G. Windows, Entry Doors and Garage Doors
Replacement windows and doors must meet Board approved standards for design. Specifications must be submitted to the Board for review prior to installation.
H. Ground Lights/Landscaping Lighting
Ground or landscape lights must be black and low voltage. They shall be limited in number to 8 per household outside the patio fence.
I. Holiday Decorations
Christmas lights and decorations are permitted to be placed in the common areas and/or on building exteriors, provided the decorations do not damage common area trees, roofs, gutters or siding. They may not be displayed before Thanksgiving Day and must be removed by no later than January 15 of the following year. Other holiday decorations are permitted under the same guidelines, and may not be displayed more than one week before or after the holiday. All holiday decorations outside the patio area must be Board approved.
J. Prohibited
The following items will be strictly prohibited: Banner or political flags, any type of sign, statue, statuette, figure or lawn ornament, plastic or artificial plants/flowers, ornamental rocks or stones, swing sets, laundry poles or clotheslines. Nothing may be hung over any patio fence. Other personal property maintained within the patio area will not be visible above the patio fence, with the exception of patio umbrellas and hanging plants.
*Any other item not covered under the foregoing guidelines must be approved by the Board of Trustees in advance of installation.
K. Gas Grills
The State of Ohio Condominium Regulations requires any usage of outside grills to be at least 10 feet from the unit.

2. Exterior Alterations:

No alterations, additions, fences, walls, patios, deck, etc., may be made to the exterior surface of the buildings, nor may any trees or shrubs be planted, transplanted or removed without prior written approval of the Board of Trustees. Additional landscape plants, which will be considered by the Board, will be a species already in use in the community, and which, at maturity will not exceed the height of the patio fence. Alteration requests are to be submitted in writing to the Board.
A. Patio Gates
Patio gates must be per approved plans. Contact the Trustees for plans and approval prior to installation.
B. Security Measures
Anyone wanting to install outdoor security and motion lights must contact the Board of Trustees for proper location prior to installation.
C. Residents Planting Flowers/Shrubs in the Common Area
1. Residents must submit planting ideas in writing to the Board for approval. No existing shrubs may be removed.
2. Beds, in front of the window(s) area may not exceed more than 3 feet from the exterior wall, and the length may not exceed beyond the arched window wall and the patio.
3. Shrubs may be no higher than the window sill. No foliage/vines of any kind are to be attached and growing anywhere on the outside of the building. Such greenery will be removed due to harming the structure.
4. No hanging flowers/plants are to be attached to the exterior of the patio fence. Hanging plants can be hung from sturdy branches of trees or shepherds hooks, not to exceed 4 baskets.
5. Annual plants are to be removed when they die or show noticeable frost damage.
6. Any shrub/tree planted at the owner's expense shall remain if the owner moves.
7. Bed areas are to be mulched using the same type and color as the mulch in the common areas.
8. Any edging used to retain mulch must be black or gray, but can be either flat or sculptured style.
D. Landscape
1. The Board of Trustees may, at its' discretion, remove from Common grounds any tree, shrub, plant or landscaping feature, including those placed by owners. Board decisions may be appealed before the entire Board at regular or special meetings.
2. If the current owner wants to remove shrubbery or landscaping in the Common Area, the removal must be approved by the Board of Trustees.
3. If the landscape was installed in the Common Area by the current owner, it will be the responsibility of the current owner to pay for the removal and replacement of the shrubbery, if the current owner wants to proceed with a different project, after obtaining approval from the Board of Trustees.
4. The Board of Trustees has designated certain plants/shrubs that can be planted around the Common Areas. The reason being, it will reduce the use of plants/shrubs that are not hearty and generally will not hold up in drought and freezing conditions.
5. Snow Removal – Streets and driveways are plowed by the Association. ONLY sidewalks leading to patios will be shoveled. Association will shovel to front door if there is a clear path (open gate or no gate). Walk and driveway de-icing is done by each resident, so prepare and purchase a de-icing agent before winter weather.
6. Building Maintenance – The Association maintains the outside of the buildings (except PATIOS, WINDOWS, AND DOORS.) Owners/renters maintain patios, windows, doors including garage doors, inside structure, utilities (except for water, sewer and garbage) and furnishings.
E. Flags
One official United States flag may be displayed from a suitable mounting on the patio fence. Banner or Political flags are prohibited.

3. Windows and Window Coverings

All window coverings whether draperies, vertical or horizontal blinds or valances, must be white, off white, beige or a similar shade on the exterior side.
Nothing may be hung or displayed from the inside windows except professionally prepared, For Sale or For Rent signs, which shall be limited in size and number.

4. Animals

A. Pets
No more than 2 household domestic pets, not bred or maintained for commercial purposes, may be kept in any one home. All animals, when outdoors, shall be maintained on a leash not more than 6 feet in length. They shall be supervised and under control by a responsible individual at all times. Such individuals shall be responsible for immediately cleaning up after their pets. No pets shall be tethered outside in the lawn or common area, nor shall any pet be tied to the patio fence. If pets become a nuisance, they may be ejected at the discretion of the Board of Trustees.
*Trustees have waived the weight restrictions as outlined in the By-Laws dated 12/1/2001, page 8, paragraph 1.
B. Feral Animals
Feeding and/or providing comfort or shelter to wild or feral animals, other than song birds, is not permitted and subject to a fine after an initial violation letter is received from the Board.

5. Vehicles and Parking

A. Prohibited
No boat, trailers, motor homes, recreational vehicles, trucks larger than ¾ ton pickups, campers, travel trailers or any vehicle with commercial advertising, may be parked on any street or driveway within the Community. Commercial moving vans when conducting contracted business, and commercial trucks, when in the area to perform service or repair work, are the authorized exceptions.
B. Overnight Parking
All overnight parking by residents or guests must be in the garage, in the limited common area in front of the garage door, in the parking spaces in front of the Clubhouse or on the side drives in such a manner so as not to block any other resident's access/egress to the garage or street. No vehicle may be parked in the Clubhouse parking area for more than 48 consecutive hours unless a Guest Pass has been issued from a Trustee. Otherwise, vehicles parked there for more than 48 consecutive hours will be subject to towing.
C. Inoperable Vehicles
Inoperable vehicles with flat tires, expired licensed tags, etc. or vehicles that can't be identified as belonging to a resident, which are parked in any Common or limited Common Area for more than 48 consecutive hours, will be towed off the premises at the vehicle owner's expense. No repair work is permitted within the Community except for short term emergency work like a flat tire, battery charge, etc. No vehicle shall be parked in any manner which blocks any street or driveway or the ingress/egress to any other garage.
Speed Limit - The speed limit within the Community is 15 mph. Reckless operation, excessive speed and parking on the lawn is prohibited.
D. Vehicles on the Oval
Vehicles on the oval have the right of way; vehicles on the spider roads must yield. Pedestrians always have the right of way; vehicles must yield to pedestrians.

6. Swimming Pool

The pool is for the exclusive use of the Villa residents and their guests. Any person who can't be identified as a resident or who is not accompanied by a resident, will be asked to leave the pool area.

Pool Rules:

a. All persons using the pool and pool facilities do so at their own risk and sole responsibility. There is no lifeguard.
b. Children under the age of 18 must be accompanied by a parent, guardian or adult resident age 18 or older.
c. Guests are limited to 5 per household and must be accompanied by a resident at all times.
d. The following are prohibited in the pool area:
- Animals or pets
- Glass or other breakable items
- Running, diving or disruptive behavior
- Excessive noise, splashing or loud radios
- Private pool parties e. Swimming is permitted only in swimming attire. Infants must also wear swimwear. Only special swimming diapers are permitted in the water.
f. Lounge chairs and/or tables are first come first served.
g. The pool will be open during the swimming season from 10:00 a.m. until 10:00 p.m.
h. The Health Department suggests that no one swims alone.
i. No personal items are to be left in the pool area overnight.
j. There is no smoking in the pool area. All cigarette butts must be disposed of in the provided receptacle.

7. Clubhouse Rental

The Clubhouse can be rented for free by any Villas resident. A $50.00 deposit will be collected to reserve the date. It is the sole responsibility of the resident to clean up after its use, and the $50.00 deposit will be returned. If the resident doesn't clean up, the $50.00 deposit will not be returned. A Villas resident MUST be present during any and all rental events.
*Refer to the Clubhouse Reservation/Rental Form for regulations pertaining to the rental of the Clubhouse. Forms are available in the Clubhouse or a Trustee can be contacted.

8. Trash Collection

Trash collection day is Tuesday and is provided by the City of Medina. Trash containers may not be set out prior to 5:00 p.m. the preceding day, and containers must be picked up and put away by 6:00 p.m. the day of collection. There is no limit on the number of trash containers. Trash is to be packaged in accordance with the City of Medina regulations.
All trash for collection must be set out at designated pick up areas only. Trash containers, when not set out for collection, must be kept inside the garage. Residents will be responsible for any trash which falls, spills or blows out of the container.

9. Solicitation and Garage Sales

Solicitation by commercial enterprises is not authorized within the Villas Community. In a like manner and due to restricted parking availability, garage sales and tag sales are also prohibited.

10. Utilities

Residents are responsible for maintenance and payment of their own gas, electric, cable television, telephone utilities, and, for calling to initiate service on the date of possession of a unit. Water, sewer and trash are paid for by the Condominium Association via the monthly HOA dues.

11. Condominium Sales

No real estate signs or For Sale signs are permitted, with the exception of one sign inside the condominium window, unless approved by the Board of Trustees. Open House signs are approved ONLY for the date and the duration of the Open House.
A transfer fee of $100.00 will be assessed upon the sale of a condominium, to be paid to the Association out of the proceeds of the sale at closing.

12. Condominium Rental

If an owner rents their condominium, they must present a one year lease agreement and proof of property insurance to the Board of Trustees. No unit will be rented to any person under the age of 22.

13. Personal Behavior on Common or Limited Common Property

Prohibited is obnoxious behavior that includes, but is not limited to, aggressive action, threatening action, lewd action, profane action, criminal action and any other actions that infringe upon a neighbor's right to enjoy their home or common property.
